General terms and conditions

The general terms and conditions of the  www.apinature.si online shop have been drawn up in accordance with the Consumer Protection Act (ZVPot-UPB2) and are based on the recommendations made by the Slovenian Chamber of Commerce and Industry (GZS) and the international e-commerce codes. 

The general terms and conditions of business operations shall govern the following: the operating methods of the www.apinature.si online shop, the rights and obligations of the supplier (hereinafter referred to as "supplier") and the rights and obligations of our website visitors and users (hereinafter referred to as "consumers").

The supplier is represented by the company: 

APINATURE d.o.o., Zgornji Brnik 145, 4207 Cerklje; VAT identification number: SI62176820; Registration number: 6312748000.  

The company is registered as a VAT payer. 
 

ACCESS TO INFORMATION

The supplier undertakes to provide the consumer with the following information: 

  • basic company information (name and seat of the company, registration data),
  • contact information allowing a consumer to communicate with the supplier, fundamental characteristics of goods, 
  • the conditions for goods delivery, 
  • clearly specified prices of goods, 
  • payment and delivery methods,
  • the offer validity period, 
  • a time-limit within which it shall still be possible to withdraw from the agreement and the conditions for withdrawal, 
  • the complaint procedure including all customer service contact details 
     

PRICES

The prices given in the www.apinature.si online shop are expressed in euros and are subject to VAT. The prices do not include delivery charges. Delivery terms and conditions are specially designated. The stated prices are valid from the moment the order is placed and are not fixed in advance. The prices shall apply to the payments performed in the manner specified in the terms and conditions of the www.trgovina.apinature.si online shop. 

Despite our exceptional efforts to provide precise and up-to-date information, some pricing errors may occur. In such cases or if there is a price change while an order is being processed, a consumer shall be allowed to withdraw from the purchase and at the same time the supplier shall set up a mutually beneficial solution to the satisfaction of both sides – a consumer as well as the supplier. 

A purchase and sale agreement between the supplier and a consumer shall be concluded when an order is confirmed by a consumer who afterwards also receives an order confirmation e-mail. From that moment on all the prices and other conditions shall be fixed and apply to both – the supplier as well as a consumer. 
 

PURCHASE ORDER PROCESS

1.    Online order overview: 

After the products have been selected by a consumer, the listing of the chosen products is displayed in a shopping cart.

2.    Registration procedure: 

On the basis of the selected shopping cart a consumer gets registered in the system by entering his user name and password.

3.    Delivery address:  

A consumer has the possibility of selecting a delivery address that is different from the one indicated during the registration process. That address shall be entered in a database as the appropriate delivery address. 

Delivery charges are determined with regard to the total value of the goods ordered. Delivery charges may, namely, be included in the price or determined in accordance with the parcel delivery prices. 

Delivery charges for an individual order depend on the product weight and other conditions laid down in the agreement and such charges shall always be indicated in the online-order overview. If the value of the ordered products exceeds 40 EUR, the delivery charges of the products distributed in Slovenia (packaging, packing, transportation, postage) are covered by a supplier. 

4.    An overview of the entire order and the payment process: 

A shopping cart overview and payment conditions shall be displayed in the layout of the online shop.

5.    Order confirmation: 

An order confirmation e-mail shall be sent to a consumer along with a notification stating that the ordered goods shall be delivered to the specified delivery address at the earliest possible date.

6.    Goods dispatch:

The goods shall be prepared and dispatched by the supplier within the given deadline. All the goods shall be delivered to a consumer's address that has been specified while placing an order. The delivery is carried out by the Contracting partner (Contractor) who shall sent an sms notification to a consumer before delivering the goods.

A consumer shall have the ordered goods hand-delivered personally at the address indicated by a consumer as a place of receipt. In case nobody is present at the address in question, the Contractor shall leave a notice in a recipient's home letterbox. Such notice shall contain the information about the place of acceptance (nearest post office) and the time limit within which the forwarded goods are to be picked up by an addressee. If an addressee fails to take possession of the forwarded goods within a deadline specified in the notice, the forwarded goods shall be returned to a sender. In that case a supplier shall be entitled to recover the incurred costs.  

Deliveries take up to 2-4 working days. The goods are not dispatched on Saturdays, Sundays and public holidays.  

If the ordered goods have been dispatched by the supplier on time and in accordance with the agreement, the supplier shall not be held responsible for the exceeded delivery time-limit caused by a Contractor. A client undertakes to waive other means of reimbursement of the incurred costs, paid purchase price and paid delivery costs, such as damage claims in the form of civil actions and similar, resulting from late delivery or different manner of delivery. A client undertakes, however, to retain other minimum rights in accordance with the provisions laid down in the Consumer Protection Act.

A consumer is required to collect the goods supplied by the Contractor at the address specified in the purchasing process and under the conditions laid down by the Contractor. Upon acceptance of the forwarded goods a consumer is required to check the quantity and quality of the received goods. Complaints submitted at a later date are inadmissible. 
 

THE PAYMENT METHODS

The following payment methods can be used when shopping in the www.apinature.si online shop:

  • pro forma invoice or preliminary bill of sale, 
  • cash on delivery (by cash or credit card), 
  • credit card payment.

 

CANCELLING AN ORDER, RETURN OF GOODS AND PURCHASE MONEY

A consumer is allowed to cancel an order no later than 24 hours after the order has been placed by sending a cancellation notice to the following e-mail: info@apinature.si

A consumer (this applies only to natural persons) can exercise the right of withdrawal from an agreement by sending an e-mail notification to the supplier no later than 14 days after the goods have been delivered. The reasons for such decision shall be clearly stated in the notification at issue. That deadline starts to run on the day the goods are collected. The only charge a consumer needs to pay when withdrawing from an agreement are the costs concerning the return of goods. The goods are to be returned to the supplier no later than 5 days after the cancellation notice has been sent. The returned goods shall be stored in the original package, they shall be returned undamaged or unused and the quantity shall remain unchanged. 

The goods shall be returned to the following address of the supplier: API nature d.o.o., Zgornji Brnik 145, 4207 Cerklje. We do not accept parcels with ransom.   

If an order has been cancelled, a consumer shall be entitled to get a refund in accordance with the law, provided that the goods are returned undamaged and unused and on condition that the quantity remains unchanged. The cost of returns shall be covered by a consumer. Your payment shall be refunded as soon as possible and no later than 15 days after receiving a cancellation notice and after the goods have been returned. A consumer shall return the goods along with an invoice for the received goods and a specification of a bank account number where the refund will be wired. 
 

REJECTION OF AN ORDER

The www.trgovina.apinature.si online shop reserves the right to reject an order that is found to be impossible to carry out under the stated conditions and due to the lack of the available data.

 

COMPLAINTS

If a consumer thinks that the received product does not suit his needs and wishes, such product shall be replaced with another product or a payment will be refunded, but only on condition that the returned product is sent to the supplier's address undamaged and unused and stored in the original packaging. If the original packaging has been opened or if a security seal has been removed, the goods may not be returned. 

If a consumer finds out that the received goods have been damaged or that some items are missing and that a package seems to have been opened, a consumer shall require the postal service provider to draw up a record of goods, take a picture of the received goods and send such evidence to info@apinature.si, so that the complaint can be properly handled. 

With the assistance of our delivery contracting partner we will make sure that all complaints will be handled as quickly as possible. 

 

PERSONAL DATA PROTECTION 

The supplier undertakes to maintain the security of all user's personal data.  

The supplier shall keep the IP addresses of all the www.apinature.si online shop visitors for an indefinite period of time. As regards the registered members, a supplier shall keep their IP addresses, name and surname, e-mail address, telephone number, primary address and delivery address, country of residence, time and date of a registration, and the archives of communication with a supplier. 

Such personal data shall be used by the supplier exclusively in order to fulfil orders, to send information material, offers, invoices and to carry out other necessary communication activities. 

A consumer may request access to his personal data as well as its correction, blocking, deletion or he may seek the restriction of his personal data processing. A consumer is also entitled to submit an objection against the processing of his personal data by sending a written notice:

  • to an e-mail address info@apinature.si 

A consumer shall also submit a complaint with the supervisory authority if he believes that personal data processing is in breach of the General Data Protection Regulation. 

Consumer's data shall in no case be submitted to unauthorized persons. 
A consumer himself shall also be held responsible for his personal data protection by taking care of the security of his user name and password and by making sure that his computer is protected by the appropriate anti-virus software programme. 

 

ONLINE SHOP SECURITY PRECAUTIONS

Various protection systems have been installed in the www.apinature.si online shop and they provide suitable protection against the potential data loss or data misuse. 

 

COMMUNICATION 

The supplier may get in touch with a consumer by using means of distance communication on condition that a consumer does not specifically oppose to such manner of communication. 

Advertising e-messages shall comprise the following elements: 

  • they shall be clearly and unambiguously indicated as advertising messages,
  • a sender shall be clearly identified, 
  • various discounts, promotions and other marketing activities shall be indicated as such. The conditions of participation in those marketing activities shall also be clearly specified, 
  • the unsubscribe method shall be clearly explained, 
  • if a consumer would like to stop receiving advertising e-mails, the supplier shall respect such a wish.
     

THE SUPPLIER'S RESPONSIBILITY

The Apinature d.o.o. company shall not be held responsible for the negative consequences of the use of the products which may arise from a failure to observe the manufacturer's instructions which, however, cannot serve as a substitute for consultations with a doctor or a pharmacist. 


The photos depicting the products found in the online shop are of symbolic and the texts of informative nature. Please read the information and instructions on the package carefully before using the products. The supplier shall undertake its best endeavours to provide most accurate information in the www.apinature.si online shop and to regularly update the selection of products. If our customers notice any mistakes, we would be really grateful if they could bring such issues to our attention. 

 

COPMLAINTS AND DISPUTES

The supplier shall respect the Consumer Protection Act in force and shall try to do its best to fulfil its obligations and deal with complaints at the earliest possible time. 

Complaints shall be submitted by sending an e-mail to info@apinature.si. All complaints shall be handled confidentially. 

The supplier is aware of the fact that the essential feature of consumer disputes, at least in terms of the judicial resolution of disputes, is a disproportion between the economic value of a claim and the costs incurred in resolving a dispute. This is the primary reason that prevents a consumer from initiating an action before the court. Therefore, the supplier shall be striving for amicable settlement of possible disputes. All relations as well as the rights and obligations that are not regulated by the General Business Conditions shall be governed by the provisions set out in the Obligations Code, Electronic Commerce Market Act, Personal Data Protection Act and Consumer Protection Act.
